| | | hit and run in canadian tire parking lot |  |  |
on sunday july 10th 2011 between 1200-1220pm my car was hit in the parking lot of canadian tire on 18th street. a great deal of damage was done and whom ever hit my car did not leave a note or report the accident to anyone working. A police report was filed so if anyone saw anything please message me or let the police know. If the person who hit my car is reading this, i would greatly appreciate you stepping up and admitting what you did. I should not have to pay the deductable because of your poor driving. |

Because you were in a parking lot its 50/50 therefor you must pay your own deductible regardless. Yes even if you’re not in your car. My sister was visiting Brandon and hit an empty car in a parking lot, she filed a report at MPIC offered to pay the deductible and the MPIC guy said you’re only responsible for your own car, parking lots are 50/50 even if the car is empty... Absolutely ridicules I know but sadly those are the facts |

my Dad opened his door and the wind caught it and hit the car beside him and he paid the deductable for other vehicle.Both were present when it happened . |

There is no way it's 50/50. You do only pay your deductable until a surcharge is applied. If someone rams your car in a parking lot and admits it you pay no deductable and assume no fault. |

No way, a few years back some guy hit my car while I was still in it in the parking lot by M&M's and we exchanged info and he ended up paying my deductible. Sorry to hear about your car OP, I have to park in a parking lot everyday for work I always dread waling out to my car damaged. |

i hit a car once and they weren't in it, it was MY FAULT! there is nooo way i was going to get them to pay their own deductible, it has nothing to do with it being their fault, so they should not be responsible. it's only 50/50 if (for example) you're backing out and hit someone who is driving past. it's NOT 50/50 if you hit an empty car. that means it would be 50% their fault, which it isn't, because they were not driving... duh |

No, they're not. I had an accident last October in the Timmy's lot by Cdn Tire. I was rightfully found to be more than 50% at fault for the accident. |

I was driving in a parking lot going done the lane between the parking spots.
A car was traveling across the parking spots and hit my car.
They were found to be at fault as they were not in the driving lanes of the parking lot.
so it is not always 50/50.
and it definitely is not 50/50 if no one is in the car UNLESS you were parked illegally. |

it's NOT 50/50 in a parking lot and I do have personal experience in this.
I was hit in a parking lot when I was not moving and it was 100% the other persons fault!!!!!!!!!!! per MPI!!! |

I see this thread like many other have getting off topic. The original post was asking if anyone has any information on the accident it self. IE: Seen the accident, the type of vehicle, person driving the other vehicle. I assume that the OP did not intend this thread to be a argument about the amount of his deductible or whether its a 50/50 fault claim.

As far as the original post, sorry I can't help out! What an annoying situation to be put into! I agree that you should check to see if Canadian Tire has cameras in the parking lot...if nothing else it might prove the accident was not your fault.
As far as the deductible conversation, this is what the MPI website says with reagrd to paying deductibles:
"Paying Your Deductible
When your vehicle has damage over your deductible, you pay your deductible to the repair shop. Then, the repair shop bills us for our portion, which is the amount over your deductible.
If the cost of your damage is the same as, or less than, your deductible, you pay the repair shop the exact amount of the repairs. If your vehicle is a write-off, we subtract your deductible from your settlement.
Once we're sure the other driver was at fault and we know they had proper Autopac coverage, we'll refund your deductible to you."

if they can get two deductibles then thats twice as much money made that only getting one |

imo we don't have the worst drivers,we have the most people complaining about bad habits lol every where else they just expect people to drive bad or have too many other issues to bother noticing bad drivers

We have the most whiners about bad driving for sure. I have driven all over canada and the world. Brandon is not bad at all.
The only stats I could find were on Canada and Manitoba is middle of the pack.

you are extremely lucky that it was only your car. my neighbor was hit almost 3 weeks ago in the Walmart parking lot as she was getting out of the passenger side of their truck and an old man in a van PEELED into the spot beside them and hit her and ran over her TWICE!!!!! she has been in HSC with 2 broken legs, broken heels, and a buggered knee since. |
