I was told by someone that Canada put a law into effect a couple years ago with regards to cancellation fees regarding cell phones because companies were charging way to much. I cancelled my cell phone with rogers a bit ago and was told my cancellation fee is $400, and I can't find my copy of papers when I signed up for them but I know no where on there was that amount for a cancellation fee. does anyone know what Canada's laws are regarding cancellation fees for cell phones and what a company is allowed to charge for it, and where would I find this info??

For the most part, its case and contract law. you sign the paperwork agreeing to the terms and therefore are legally bound by it unless there is a higher power lower making some of the terms illegal, in which case that part of the contract void abinatio(never valid) Most cell phone contracts I have seen have a clause that states if you cancel early, your penalty will be $XX(usually 10 or 20 dollars) a month times the number of months remaining in the contract. For instance, when I moved out of Saskatchewan, I have 27 months left on a newer 36 month contract. Had I cancelled the contract, it would have cost me $540 plus the cost remaining on the phone that I had included in the contract. This is why you will see so many people trying to get someone to take over their contract. I actually paid a fellow $100 to assume my contract and phone.

It does suck that it is so high. But at some point during your time with rogers you will have received a contract that states there cancellation fee.
Everytime you upgrade a phone or change a plan that extends your contract time you will have received the info.
If you entered a contact before Jan 2012 you are subject to the max $400 termination fee. After Jan 2012 you basically owe them for the phone less what you have used. ($360 retail phone over 36 month contract is $10 a month times the number of months you have left plus being the lesser of $50 or 10%
of the monthly service fees for the services that you have subscribed to on a Service Agreement Term and Data Term.
If you still have not cancelled or have just cancelled you should be able to reactivate and then transfer service to someone. You both agree to some basic terms and go from there. You can give up the cell phone to new person or they can get there own. I would just make sure they change phone number ($10 i think) |
