Quick question!!  
When me and my ex broke up our child was in daycare, and we do one week on one week off, our child tax currently gets split between us, our child is out of day care ( has been for months)and she comes to me during the day, which means I have her more then 50% of the time! Does this mean I’m entitled to the other half?

"Do you share custody of a child?  
You share custody of a child if the child lives with two different individuals in separate residences on a more or less equal basis, such as:  
 
the child lives with one parent four days a week and the other parent three days a week  
the child lives with one parent one week and the other parent the following week  
any other regular cycle of alternation  
In these cases, both individuals may be considered primarily responsible for the child’s care and upbringing when the child lives with them. Each individual will get 50% of the payment they would have received if the child lived with them all of the time.  
 
If you have just entered into a shared custody situation for your child(ren), you have to apply for the benefits (see How do you apply?). If you already get the benefits, you have to tell us by using one of the following methods:

calling 1-800-387-1193  
sending Form RC66, Canada Child Benefits Application, indicating shared custody  
sending a letter explaining the shared custody situation

That would be a question best answered by the CRA.  
So long as 100% of the child tax credit is being spent on the child I don't think it should really matter

I used to work in Child Tax, but it's been a number of years now so you will want to take what I say with a grain of salt. Some things have changed in this area since I last worked on it.  
 
Generally, they will count the overnights. So, if you're one week on, one week off still, but you happen to be "daycare" during your week off if the other parent is working or going to school (the child sleeps at the other parent's house for week, then your house for a week still), odds are they would still consider it shared custody for the purposes of administering the CTB.  
 
The nature of the arrangement hasn't really changed in that case, just the child care arrangements.  
 
I know that seems weird and somewhat counter-intuitive, because you'd be like, "Hey, I have my kids 75% of the hours in a two-week period because I have them all day, ever day," but it's the reason *why* you have them more that's important.  
 
It's like marital status for Child Tax. Sometimes it's not about who you share your bed with, but who you share your kitchen with.

I does matter, because it's geared to income. There could be a significant difference in entitlement due to income disparity. Their mandate that each person receive the correct amount, no more and no less.

Child tax is based on what you have provided CCRA in legal custody documentation. From what I recall If you have the children 60% of the time you are entitled to 100%: anything less is prorated and shared.
