Why 50 / 50? Stand your ground. If he t-boned you he is clearly at fault for the accident. Hire a traffic accident analyst if you have to. You were obviously established in the intersection. I would fight this one. Why should it be up to the victim to flag down a passer by to prove innocence? I have actually made a point of calling MPI more than once to report my account of an accident I was not involved in just so people don't get screwed. Don't just pay it! Fight it out!

Getting t-boned does not determine fault in an accident at all. It determines who got to the space first not who had the right to be there. Anyhow my guess is that since the other driver admitted to trying to run the yellow he is saying his light was yellow. Your friend is saying her light was green. Someone is incorrect. With no witnesses it’s 50-50. Sorry that does not help your friend. Hopefully they find a witness. That is friendly advice for people is that if you see an accident at least leave your name and number. Can really help in situations like this one.

Hi there I am the victim that got hit. I was unable to sign in to ebrandon st first. I understand that mpi needs to listen to big parties HOWEVER this is pretty straight forward in my opinion. I was stopped at a red. My light turned green. I looked left and right and at least 2 vehicles were slowing down and were able to stop (so clearly they didn’t have green anymore. They would have seen yellow or red) I then proceeded to enter the intersection (same with the vehicle trying to turn ahead of me (so he would have had GREEN too) it was a little slick so it’s not like I was quick off the line. Once in the intersection I then saw a van in the left lane coming barreling toward my son and I. The person in the right lane beside him was already stopped. So who do you think was at fault?! Yes I should have gotten a witness but I didn’t even think of it st the one. I have never had any incident with a vehicle before. I got rocked so I wasn’t really thinking clearly. I have been driving almost S long as this kid has been alive. Perfect driving record while this kid is still on probation. They should look at all that information before telling someone they might be held 50% responsible. I am asking if anyone was at the intersection of queens and 18th on Thursday feb.15th around 2:30 pm to please come forward! People were st a&w, other drivers in the intersection. Anyone in the strip mall see anything? Please spread the word and contact the mpi tip line. Your information would mean so much to me and my family. Thank you so much!

To be clear I never said I did not believe the story. But with no witnesses all they see is 2 cars that hit each other. That is really poor form that no one left their name at what sounds like a pretty serious accident. Good luck.

find yourself a traffic accident analyst to recreate the scene. They are professionals. My wife had an accident @ 6th and Victoria 20 years ago at 2AM with a taxi that ran a red light and t-boned her and slid her all the way across the intersection. Not a soul around. The taxi driver lied. Said she ran the red. The traffic analyst put the scene back together and in the end a court proceeding got it all sorted out with MPI and the other party. Long story short you can pay or you can fight! It took months but be patient and fight if you are in the right.

This is why I have a dashcam in my vehicle just in case I'm in an incident like this. It will give an unbiased report of what happened. I look at it as insurance and I hope that I never need it.

Hopefully someone remembers the accident and comes forward, it will clear up the whole issue and MPI will be able to place fault where it is needed.  
 
MPI looks at as there was an accident.  
Person A entered the intersection and there was a collision  
Person B entered the intersection and there was a collision  
 
Person A says they had the green light  
Person B says they had the green light  
 
Who is at fault??  
 
If Person B has a witness statement saying Person A ran the red light, or a signed statement from person A saying they were in the wrong, not a verbal statement. Then it all goes away. Sometimes just trading info isn't enough.  
 
This is why a big benefit for witness to give their number to both parties. You don't have to hang around and if there is an issue, you can be contacted.  
 
In all honesty if I had drove by and seen the aftermath, I would lean toward the car that was T-boned as car at fault. It would appear that, that was the car in the wrong place. Not at all saying that is the case in this instance, but looks can be deceiving.  
 
Check with the restaurants on that corner, maybe they have security camera that points out in that direction. Doesn't necessarily need to see the traffic lights. As based on your story all you need is the movement of traffic. if you can see cars stopped north and south and cars moving east and west, should be enough to prove fault.

I understand your frustration with this, but the fact is of the matter is that there is no concrete proof of what actually happened, and if MPI took the kids word over yours or your word over the kids, and someone took the other driver to court that wouldn’t get too far! The liability decisions are all made from the Highway Traffic Act, unless that has changed but I am pretty sure it hasn’t. If there isn’t black and white evidence, then unfortunately when one person lies it’s a 50/50 split, because believing one person cause they were a girl, or one because they were older or because they had red hair and not blond.... is not a valid reason. You won’t get very far if you appeal it because it’s still he said she said. View  
The situation as at least you and your son are okay. It could have ended a lot worse and heaven forbid someone was injured ... an affect to your licence would be quite minor .....

Just another thought... you saying that it’s obvious you were my at fault isn’t quite as clear as you seem to think I don’t think... I understand you say there was someone turning but again, no evidence of  
That so... the story can easily be turned to the kid has the green and you ran the red. Right? Just trying to get you to see both sides here and how it can be viewed both ways

Just by luck,maybe A&W has a security camera pointed at their drive through that might have caught the accident.
