On Tuesday the City of Brandon plans to do first reading to a bylaw concerning vehicles on your property.  
This i:ncludes vehicles not registered and those registered but not being used.  
If the vehicle is on your property - in your back yard, in a driveway, wherever!  
 
So beware Brandonites!  
Once passed third reading you will have to deal with these vehicles.  
If you don't you'll be fined!  
 
The city wants to control everything!

No different that other cities. I''''ve seen boats and cars on people''''s front lawn in the city, that are eye soars in neighbourhoods. People should be fined for those, does not matter if they have registered plates or not.  
 
Like other cities they should also ban tempo shelters.

In 1982 the sitting prime minister of the day signed a charter of rights and freedoms bill for our nation. There were many people who were upset about the one omission from this bill, many of those who were upset claimed to be Conservative, but the truth is it wasn't just Conservatives, but all people owned property. They warned that the omission of the right to own property, would allow governments of the future to overlook the right of the property owner, and allow the state, encompassing federal, provincial, and municipal or city jurisdictions to determine the fate of property or the property owner.  
 
Isn't it upsetting to see areas that protested the omission of property rights from the charter, are now proving the warnings would become fact, and were going to be exploited by those very people who believed in the right of owning property to do as one wanted to within legal boundaries. Who would have thought of all the laws that would be proposed and passed to decide what is best for the individual, and by the omission, no legal right to challenge in court.  
I at times claim to be a liberal, but from what I see, every political system seems to be on the left of me, and knows what is best for me and will legislate laws in the interest of the state not the individual.

I believe this enhanced bylaw is due to Deveryn Ross showing up at council and explaining how the bylaw was actually three bylaws and telling the city & council to review their own bylaws so they make some sense! Residents do need to get involved. Too bad not all of us have the legal know-how needed to decipher city mumbo jumbo.  
 
Any city pushing laws and bylaws on it’s residents also need to abide by their own laws. For example, grass/weeds no higher than 8”? This issue isn't enforced now so this "new" bylaw won't change anything. Also, the city needs to get on board and be the example by keeping all city property clean and maintained first and foremost! They cannot be the exception to the rule. Residents are already mowing and clearing snow from city property. Their neglected property isn't a matter of manpower. Work smarter, not harder, isn't that the saying? There are enough salaries at city hall to get the work done. Properly.  
 
How will this new & approved bylaw be enforced? Will it be the ridiculous, and in my experience, ineffective complaint-driven system or will the city target certain areas as they did before and thus urging Ross to speak at the council meeting about his derelict bylaw experience? Will this bylaw be fairly enforced across the city? How? I guarantee if the city wants to nail us for 8.5" high grass, they my as well smoke it because we’ll be scouring the neighbourhood and city and asking the city why others are allowed to do what we are not. Laws and bylaws shouldn’t just be for some of us, as it is now. Bylaws aren't there for officers to have an opinion about. They are in place for officers to enforce. Put those expensive and oversized bylaw trucks to good use. What are they hauling in the bylaw/ACO trucks? Certainly aren't catching moose or hauling away fences or trees that are falling into the alleys.  
 
Another thing I don’t understand, and maybe I missed it but how is it different for a vehicle (derelict?) sitting in yard open for us to see any different than vehicles under tarps in yards? Both can be eyesores, both attract rodents and both can be used as kindling for arsonists. A tarp doesn't mask anything.  
 
I feel this is just another useless bylaw (that has been reviewed & enhanced) thrown at residents to appease some but still a bylaw that will not be enforced properly(as in the past nuisance bylaws) and when it is enforced, it will be enforced unfairly.

It's pretty bad when you have derelict vehicles in your neighbourhood but bylaw encourages the owners to get that insurance from MPI which allows the derelict vehicles to sit for another six months.

Very true that:  
*the city doesn't follow its own bylaws. Yards/boulevards not mowed. Backlanes full of dumpsters!  
*people can have yards full of junk/garbage never mind cars

Just wait for this to be pushed through council if Desjarlais gets his way! He asked administration to look into this!  
You'll need video surveillance to prove to the enforcers that you DID clear THEIR sidewalk but the city grader came by afterward and filled it all back in.  
 
Many of us already maintain city-owned property free-of-charge in summer & winter. If the city DEMANDS that I clear their sidewalks, I will stop doing any of it and then they can clear it themselves or call the angels. The city "forgets" that many of us mow their property in summer and clear snow on their property in winter VOLUNTARILY already. If council is going to approve ridiculous bylaws such as this suggestion, they better figure out how to discount our property taxes for all the work we do for them while they keep raising taxes like we're made of money.  
I don't even think forcing residents to do work on city property is legal. Is there a lawyer in the house that can elaborate on these idiotic bylaws the city creates?  
Enough is enough already. We need more great minds, way less government.

How does the public get involved, is this saying if you own more than one vehicle you must register all year even if you are not using it or want to save on registration or the city takes it and charges you fine plus thousands in impound fees?

Deveryn Ross was right, the old bylaw did need to be updated, since MPI no loger uses plate stickers. Basically, every car in the city of Brandon that had covered up their stickers (required by MPI upon renewal) was now by definition in the old law, an abandoned vehicle.  
 
My dismay with the new law is that they appear to have just removed the sticker component and still left it up to a "judgement call" by the enforcement officer. That is BS.  
 
If my car shows NO SIGNS of being parted out and carries a current registration (that includes storage coverage) then by definition it is not derelict or abandoned. It should be written into the new law that PROOF OF REGISTRATION or STORAGE COVERAGE from a recognized insurer (MPI, SGI, etc) is enough proof that a vehicle is not derelict.  
 
At one point years ago, My wife and I stored our car in her mother's driveway for six months with the proper coverage because we did not to use it and were cash-strapped at time. We had the PROPER storage insurance on it from MPI because we fully intended on starting to use it when our situation improved. That is exactly what we did. That car was never abandoned or derelict, yet had a city employee taken a dislike to my mother-in-law, we would have been fined for that, despite having proper coverage.  
 
There are other people I know that have a summer car and a winter car... again the definition of not derelict or abandoned. This by-law needs an amendment.

i didnt read the bilaw but im in agreement with Dons rant, people have a right o do what they wish with their property.  
 
i also wanted to point out that when our town decided to try and enforce the bilaws, many of them were found to be illegal. Municipalities do have to follow the municipal act when writing bilaws and that includes having a clear measurable written rules,ie. leaving nothing up to the opinion of a bilaw officer, many municipalities either dont know this or choose to ignore it and that actually makes the bilaw illegal and unenforceable

Even if you have lay up insurance on a vehicle it won't meet bylaw standards.  
 
I agree the bylaw needs amendment!  
 
Citizens need to show up at the council meeting Tuesday.

The whole conversation was around MPI stickers and there are no stickers being issued anymore. This reading was a waste of time arguing a point that no longer exists.

Here's the way I look at it. I put out the money to buy the land, therefore I own it. I should be able to do or put whatever I want on it because it's mine. If I bought a car, and I wanted to paint it red instead of yellow, why can't I? It's mine, I should be able to do whatever I want with it. I thought Canada was a free country. I guess I was wrong.

It doesn't matter that MPIC is issuing "blank" stickers!!!  
This clause in the bylaw was removed.  
 
If you have lay up insurance on your vehicle ON YOUR PROPERTY and IT IS NOT BEING USED you will get a fine!! It's considered "derelict"!!  
 
So much for seasonal use of vehicles!

I see great work in my quarter of the city. I see how much work the property owners are doing to maintain the grass on the curbs; clear the snow.  
 
I am thankful to all of them for their due diligence and generosity in this work. I like the fact that my neighborhood is well maintained and safe.  
 
I do think however that the neighborhoods need to work with the city to delineate policy regarding yard appearance, grass maintenance, and snow clearing.  
 
My neighbors shouldn't have to dig us out or mow all curb patchesIt's not their job; I think they should be compensated by the city.
