If I read between the lines of what you posted, it seems that part of the reason why those particular seats weren''t replaced was because they would have been empty (i.e. the car was parked). The OP specifically said that the seat was occupied, so that maybe changes the criteria.
I mean, the seats are not specifically excluded in MPI''s list of exclusions, which details such things as CD''s, tires on actually on your vehicle, or tools, clothing or cameras. So I would infer that in some instances, they will replace them.
