TENDER FOR SALE OF FARMLAND
Sealed tenders clearly marked with the words ?Land Tender - Turbak? will be received by ROY, JOHNSTON TDS, 363 ? 10th Street, Brandon, Manitoba R7A 4E9 (Attention: Stephen K. Branigan) until Thursday, October 29th, 2026 at 5:00 p.m. for the purchase of the following land:
PARCEL ONE:
THE SW 1/4 OF SECTION 10-12-29 WPM
EXC FIRSTLY: ALL THAT PORTION LYING SW OF THE NE LIMIT OF ROAD PLAN V120 BLTO
AND SECONDLY: ALL MINES AND MINERALS AS SET FORTH IN TRANSFER 59852 BLTO
PARCEL TWO:
THE SE 1/4 OF SECTION 10-12-29 WPM
EXC ALL MINES AND MINERALS AS RESERVED IN THE GRANT FROM THE CROWN
PARCEL THREE:
THE NE 1/4 OF SECTION 10-12-29 WPM
EXC ALL PETROLEUM, NATURAL GAS AND RELATED HYDROCARBONS AS SET FORTH IN TRANSFER R6631 BLTO
PARCEL FOUR:
THE NW 1/4 OF SECTION 10-12-29 WPM
EXC ALL MINES AND MINERALS AS RESERVED IN THE GRANT FROM THE CROWN
(collectively referred to as the ?Land?)
Roll no. 200500, 200600, 200700, and 200800 in the RM of Wallace-Woodworth. All land on title no. 3286985/2. Consisting of farmland, hayland, pastureland, barn and outbuildings with tin roofs, house and 9 tin grain bins.
House is on SE10-12-29W: Built 1967; 1288 sq. ft.; 3 Bedroom Bungalow; 1 and 1/2 baths; Propane Furnace; New Shingles in 2019.
Tenders will be received on any one or combination of the above noted parcels making up the Land.
Conditions of Tender
1. All tenders must:
a. be in writing with the tenderer?s name, address, email address and phone number;
b. indicate the parcels the bid is for;
c. be accompanied by a bank draft payable to ROY JOHNSTON TDS for 10% of the bidder?s highest bid included in the tender;
d. be submitted in a sealed envelope with the words ?Land Tender ? Turbak? clearly marked on the front; and
e. be submitted by the deadline noted above.
2. Interested parties must rely on their own inspection and knowledge of the property and not on any representations made by or on behalf of the Vendors.
3. Tenders must be received on or before Thursday, October 29th, 2026, at 5:00 p.m.
4. The deposit will be returned if the tender is not accepted; or forfeited to the Vendor if the tender is accepted and the purchaser does not complete the purchase. On acceptance of the tender, the balance remaining will become due and payable on the closing date of November 30, 2026.
5. The highest or any tender need not be accepted.
6. All tenders submitted must be unconditional.
7. No submitted tender may be varied or withdrawn prior to the notification of acceptance or rejection.
Terms and Conditions of Sale
8. The bidder whose tender is accepted will be required to complete a formal agreement covering the terms and conditions of a sale within 7 days of acceptance. If the balance of an accepted tender is not paid as of the closing date, of November 30, 2026, or earlier, the deposit will be forfeited as liquidated damages and not as a penalty.
9. The Vendors are retaining all mines and minerals on this Land owned by them.
10. The Land has not been listed for sale with any agent, and no sales commissions will be paid to any agent representing any tenderer.
11. The land is subject to surface leases, and a Conservation Agreement with Manitoba Habitat Heritage Corporation (Caveat No. 1162108/2), all of which shall remain on title. For information on the title or surface lease income please contact Stephen K. Branigan, at Roy Johnston, TDS.
12. Current tenant(s) of the land shall be permitted until April 1, 2027, to remove any property, including grain from the bins.
13. The Land and buildings are tendered on an ?as is? basis. The Vendor makes no representation or warranty with regard to the condition, suitable use, size, or zoning for any of the land nor with respect to any of the buildings located on the Land.
14. Property taxes will be paid to December 31, 2026, and there will be no tax adjustment or lease rent adjustment on closing. All other taxes including GST and land transfer tax (if applicable) shall be the responsibility of the tenderer. Each of the Vendor and tenderer shall be responsible for their own legal fees to complete the sale.
15. The Vendors request access and possession of the residence and buildings until May 1, 2027, or such other time as can be agreed upon.
