i am trying to find out about common law. broke up with a women and shes trying to keep all my furniture and bedding and living room stuff saying we are common law and that that stuff is hers also we have only been together 15 months we have lived with eachother off  
and on over the past year there would be times where we. would break up for a month or 2 i would be kicked out of the apartment for that time . so we havent really lived together or been togetner  
15 months straight has been breaks inbetween . so im wondering where inwould go to look at the laws of common law am i really getting scrwed out of my stuff i worked long and hard for. so if anyone woluld know where inwould go to  
look or  
contact please let me know

Unless you have a child together, you are not considered common law in Manitoba until you have lived together for 3 years. For income tax purposes though, Revenue Canada requires you to claim as common law after living together for 1 year. Your property would not be hers, as it would fall under the Manitoba laws.

Read this link. Should tell you what you need. Most of being common law refers to property and pension. She doesn't have any rights to your personal belongings. Call a lawyer if you need clarification.

Sounds like she is taking you for a ride. People are correct 3 years without a child. Unless it is bought together while in the relationship all your stuff before hand is still yours.

Things that you have purchased together while together MAY be shareable, but I'm not sure on that. The same with debt.  
 
One question that I've wondered about; when does the common law sharing of assets/liabilities start? Let's say that you're living together for 3 years, no kids. You are now common law. In those first 3 years, you've purchased $5,000 of furniture while your other half hasn't purchased anything. After the 3 years of living together, you split up. Is the other half entitled to half of the furniture? Does it start from day one, or day one after 3 years?

Good luck getting your stuff. My daughter moved out and her ex only allowed her some of her belongings that she brought to the relationship. The rest he destroyed or sold or kept. Don't know why he's even have wanted most of them except to try and control her.

Once you satisfied the common law rules everything becomes fair game. So you lived together for 15 years everything in that period is considered. Women can be ruthless, best to get a lawyer and have them advise you. It will cost you either way.

I thought you were common law in the eyes of the law after 6 months.?  
 
but i read that any properties accumulated before the relationship are not shareable if you split. it's only properties / money / debt you accumulated after common law status that is shared.

everything we bought i payed for got signed for and delivery signature was all by my even on the recepits it says my name and signature not hers her name is no wheres in the receipts

we werent wven together 6 months straight without breaking up for a few weeks so is that still common law

As you haven't mentioned having any kids together, then no. To be common law without kids, you have to be living together for 3 years (36 months).  
 
Some people are just a__holes when it comes to a relationship breakups. My ex was nasty. So glad that she is my ex. Should have gotten out years earlier.

In Manitoba she would need to have hit that 3 year mark to hit you up. Unless you have declared yourselves as common-law to the govt and you have no kids together.

Unless you've been together for 3 years or have a child your stuff is still yours. Trust me I just went through all this with a lawyer when I split from my ex.
