CharlieBrown said "Just watched a pretty shocking interview with Keith Wilson, who is a very respectable lawyer that is representing former Premier of the Province of Newfoundland for a period of 10 years in the 1980s. It's a really interesting story if you do not already know about it. The Honorable Brian Peckford is the last surviving member of the small group that wrote the "Canadian Charter of Rights and Freedoms" which became a Constitutional document as part of the 1982 Constitution Act. Brian Peckford, now in his 80s, decided to sue the federal government for vast violations of the Canadian Charter of Rights and Freedoms. His lawyer, Keith Wilson, has spent the better part of this entire year, bringing the case before the Federal Courts. This is a very high level legal challenge against the Canadian Government, and the interview I watched with lawyer Keith Wilson this last week revealed some very horrific political decisions on mandates, that were made not only by the federal cabinet, but by high level public health officials who imposed very serious restrictions on Canadians knowing that they were not based in science.
Anyways, if anybody is interested, you can hear lots of about this legal case by going to YouTube and searching for Brian Peckford. Brian has spent the last year speaking publicly and on podcasts about the history of the Canadian Charter of Rights and Freedoms, and his claims (as the last surviving author of this Constitutional document) that these rights are being routinely violated.
I would encourage anybody with the interest and time, to do a YouTube search for this week's podcast interview with Keith Wilson who summarizes some pretty shocking things that came out of this month's federal court hearings. In particular, there is an interview with Keith Wilson out this past week, on the "Viva Frei" YouTube Channel.
I think many people aren't really comprehending the full picture here when we contrast citizen rights protected by the Charter, and the government's imposition of mandates whose decisions are not based in science. Keith Wilson speaks about some of the very concerning answers given this past week by high level public health officials, including high level staffers working for federal ministers, who fail to understand the full ramifications of their decisions.
What you will find out in this interview, is that this week's decision to discontinue ArriveCAN, the mandates and border restrictions, are likely the fallout from this legal case, where government lawyers decided just prior to the public announcement of a "suspension on September 30" follows them making a motion in court to discontinue the lawsuit on the basis that the process was now "moot" given that they decided to suspend these mandates.
I find these tactics to be alarming and horrific. To think that a private citizen would spend that much money hiring a legal team to spend a full year bringing a public interest case before the courts, and then for federal lawyers to reverse course and drop the mandates, and use a year's worth of public money to damage Brian Peckford's case by trying to now force it to end so that there is no damning court decision, is criminal and should never be allowed.
Anyways, yea ... really interesting interview if you have the time: search "Viva Frei Keith Wilson Brian Peckford" if you have the time and interest, to see where this is at [the interview begins at about 10 minutes and 30 seconds into the program].
My suspicion is that the motion to dismiss the case as now "moot", will be dismissed, and this case is likely to end up before the Supreme Court by year's end or in early 2023. "
The same measures, restrictions, mandates and guidelines temporarily introduced to protect public health, reduce pressure on healthcare facilities, prevent unnecessary suffering and save lives whilst slowing the spread of infection.
Anyone who believes those temporary measures violated their ‘freedom’ is unhinged.
It is the government’s responsibility to protect public health.
