Ontario man fined $305 for smoking. Petty or warranted?

This story is making the rounds today...
An man in Ontario has been fined $305 for smoking in the rig of a tractor-trailer because it is technically considered a workplace.
Having strict smoking laws in our city, is something like this also technically consdered an offense here? In your opinion, is this something that it's important to hold the line on, or should they be letting it go in favour of enforcing other laws?
