with those circumstances i doubt hed be able to hold your damage deposit and if he does for a $30 fee you can appeal the decision, cheaper then paying an inspector, most issues are worked out before it gets to that tho
how much is the damage deposit, last inspector i had cost $300 and that was a few years back so going that way may not be the most economical option
ps after you talk to the landlord if he will not let you out of the lease and give your damage deposit back tell him you will be or have already been in contact with rtb and see if he changes his tune, trust me as a landlord they are a pain to deal with even if you are right so he might cave because its easier
