So question ! I have won joint intern custody of my child! I am supposed to get him every second weekend! My question is , if my weekend falls on a major holiday , and I get denied my visit or told I can't have him that weekend , what are my rights !

Do you have an 'enforcement' clause in your interim order? These are sometimes i:ncluded in high conflict orders which allows law enforcement to intervene. Otherwise, you will have to speak to your lawyer again to see what they suggest.

The key is communication so that these weekends are planned out in advance. For example, Mother's Day and Father's Day have the children spending that weekend with that parent, whether it is the second weekend or not.  
 
Other holidays have to be negotiated. Keep a record of the negotiations for future court meetings. My ex tried to demand seven of the eight weeks during the summer and this lack of reasonable discussion contributed to him not getting full custody.  
 
If it is your ex's birthday or there is something significant happening in the child's life that weekend, negotiate to switch it to the next weekend and your cooperation will look better to the judge than holding the ex to the "every second weekend" legal order. Weekends 3 and 4 instead of weekends 2 and 4 so that the child can be with the cousins that are visiting on weekend 2 means you care more about the child than your legal rights.  
 
Have you been to the provincially run (free) workshop "For the Sake of the Children" or whatever it might be labeled now?

However, when will the mother be expected to abide by the court order? It's typically the men who get "shafted" so to speak in custody arrangements. To the OP, you need to exercise your right as the father and speak to your lawyer. Obviously this situation is high conflict and communication is only effective when BOTH parents are reasonable and when BOTH parents are acting in the best interest of their child. Im so sick and tired of hearing that Dad has to think of his child and blah blah blah when he could possibly be doing that already. Why is Mom planning events or activities on weekends she knows aren't times she has her kid. Before too long the child is gonna not want to go spend weekends at Dad's house cause there are sports involved, hanging out with friends. I stood up in court with my spouse and a judge told us visits with Dad should be scheduled into the child's life and are just as important as the time they have with mom. However, OP you need to speak to your lawyer before too many weekends get planned that you get squeezed out of. I've lived this scenario and many times Dads get screwed because they are trying to be good fathers and don't want to be confrontational with the Mom. If and when the scenario is reversed you can bet the Mom would scream bloody blue murder that Dad wants their child in her weekend.

All major holidays should be negotiated seperately, ie. Christmas, Easter, New Years, or whatever holidays you consider major, and the kids breaks from schools like spring break and summer, and also birthdays (either kids or your own).

See the thing is , she has gotten him for the past 2 Christmas because there was no court order in place , so she ran the visits whenever she felt like it ! But this time , with a court order , my visit lands right on Christmas ! No doubt she's gonna try to find a way out of it ! What can I do if she denies me that visit

get to your lawyer now and get it ammended to include what youre wanting for holiday visitations

get on it now. your court order needs to be very specific about how Christmas and all other holidays should be handled
